If you are injured in an automobile accident caused by someone else's negligence, you will have a personal injury claim against the responsible party's insurance company. You are the claimant. The insurance company will assign your claim to an adjuster who will be responsible for resolving your claim. Your personal injury claim will include certain recoverable elements including medical expenses, lost wages, pain and suffering, permanent injuries (if any), disability, and scars or disfigurement. Claimants should file all of their medical expenses with their group medical plan, if any, and should apply for any applicable medical payment coverage on their own auto policy. We encourage our clients not to rush into a settlement and to make sure they have either completely recovered, or know the extent to which they have not recovered, before settling. While not every claimant needs to hire an attorney, anyone injured in an automobile wreck should at least consult with an experienced personal injury attorney. Most firms, including ours, will provide free advice or consultation. The fact that you consult with, or even hire, an attorney does not mean you will be filing a lawsuit--it will just result in a more level playing field. One important fact to remember: the adjuster works for the insurance company, and his job is to save his company money. He has no legal obligation to you. You should have your own separate legal advice.
