Unfortunately, negligence can sometimes result in the death of a family member. In North Carolina, this is referred to as a "wrongful death claim." While there is no amount of money that can replace the life of a loved one, the law does provide for compensation in this situation. Such a death could result in economic damages (such as the death of the wage earner in a family) and will always result in noneconomic losses to the surviving family members. The noneconomic elements of damages include the loss of companionship, advice, protection, society and other intangibles. The evidence of the relationship the decedent had to each of his/her next of kin would determine the reasonable compensation for this aspect of the wrongful death recovery. Because of our vast experience with these claims, we are sensitive to their delicate nature and emotional impact. You can never recover adequate compensation for such a loss, but the law does allow families to seek justice when confronted with this disastrous loss. (See "Serious Injury")
